Identifiable visual representation: The individual must be identifiable in the image or video, which does not have to be real. Even an AI-generated image is covered under the law if it is a close enough likeness.

Intimate content: The image must show the person’s genitalia or depict him or her in a sexual act for it to be pornographic.

Expectation of privacy: The person must have a reasonable expectation that the image or video will remain private. Pornographic content creators on social media platforms, for example, cannot reasonably expect their content to remain private. Sharing such content would therefore not constitute revenge porn, though it could be a copyright violation.

Intent to harm: To be considered revenge porn, the defendant must share the image or video with intent to harm, harass, intimidate, or threaten.
